⚠️ ZERO TOLERANCE POLICY
Selfhost SMS Gateway enforces a strict Zero Tolerance Policy against spam, fraud, and any form of unsolicited messaging. Violations will result in immediate account termination without refund and may be reported to Myanmar law enforcement authorities.
1. Definition of Spam
- Unsolicited Messages: Any SMS sent to recipients who have not provided explicit consent
- Opt-out Violations: Continuing to send messages to recipients who have opted out
- Spoofed Sender ID: Using false or unauthorized Sender IDs
- Deceptive Content: Messages containing false or fraudulent information
- Harvested Numbers: Using phone numbers obtained through unauthorized means
2. Client Responsibility & Liability
🔴 CRITICAL: SOLE RESPONSIBILITY CLAUSE
By using Selfhost SMS Gateway services, the Client acknowledges:
- The Client bears SOLE and EXCLUSIVE responsibility for all SMS messages sent through their account
- The Client is FULLY LIABLE for all content, recipients, and consequences
- Selfhost SMS Gateway acts solely as a technical transmission platform and bears NO responsibility for message content
- Any legal claims, damages, fines, or penalties shall be borne entirely by the Client
3. Opt-in Requirements
✓ Valid Consent Methods:
- Website Form: Clear checkbox (NOT pre-checked) with explicit consent language
- SMS Keyword: Recipient sends keyword (e.g., "YES") to opt-in
- Double Opt-in: Initial signup followed by confirmation (RECOMMENDED)
- Written Consent: Physical or electronic signed consent form
4. Opt-out Requirements
📋 Opt-out is a fundamental consumer right under Myanmar Consumer Protection Law (2019)
- All marketing SMS must include clear opt-out instructions
- Opt-out must be free of charge to the recipient
- Opt-out requests must be processed within 24 hours
- Maintain an up-to-date suppression list of opted-out numbers
5. SIM Route & Operator Notice
📱 SIM Route Technology:
- SIM Card Ownership: Clients use their own SIM cards. The relationship between SIM card owner and mobile network operator is direct and independent of our platform.
- Operator Policies: Mobile network operators (MPT, Telenor, Ooredoo, Mytel) have their own terms, pricing, and fair usage policies that apply to SIM card usage.
- Delivery Reports (DLR): Message delivery status depends on mobile operators and is NOT guaranteed by our platform.
- Throughput (TPS): Actual SMS sending speed varies by operator network conditions and is outside our control.
- Sender ID: SIM route uses the SIM card's phone number as sender. Custom Sender IDs are NOT available with SIM routing.
- Operator Blocking: Operators may block or throttle SMS if they detect spam patterns. This is operator policy, not platform limitation.

8. Indemnification
🔴 INDEMNIFICATION CLAUSE
The Client agrees to indemnify, defend, and hold harmless Selfhost SMS Gateway from any claims, damages, fines, or penalties arising from the Client's messaging activities. This obligation is unlimited in amount and survives termination.

- Opt-out တောင်းဆိုမှုများကို နာရီ ၂၄ အတွင်း လုပ်ဆောင်ရမည်
- Opt-out ပြုလုပ်ထားသော နံပါတ်များ၏ suppression list ထိန်းသိမ်းရမည်
၅။ SIM Route နှင့် အော်ပရေတာအကြောင်းကြားချက်
📱 SIM Route နည်းပညာ:
- SIM ကတ်ပိုင်ဆိုင်မှု: ဖောက်သည်များသည် မိမိတို့၏ SIM ကတ်များကို အသုံးပြုသည်။ SIM ကတ်ပိုင်ရှင်နှင့် မိုဘိုင်းကွန်ရက်အော်ပရေတာကြား ဆက်ဆံရေးသည် တိုက်ရိုက်ဖြစ်ပြီး ကျွန်ုပ်တို့ platform နှင့် သီးခြားဖြစ်သည်။
- အော်ပရေတာမူဝါဒများ: မိုဘိုင်းကွန်ရက်အော်ပရေတာများ (MPT, Telenor, Ooredoo, Mytel) တွင် SIM ကတ်အသုံးပြုမှုအတွက် မိမိတို့၏ စည်းမျဉ်းများ၊ စျေးနှုန်းများနှင့် fair usage policies များရှိသည်။

⚠️ 零容忍政策
Selfhost SMS Gateway对垃圾邮件、欺诈和任何形式的未经请求的消息执行严格的零容忍政策。违规将导致立即终止账户且不退款，并可能向缅甸执法机构报告。
1. 垃圾邮件的定义
- 未经请求的消息： 发送给未提供明确同意的收件人的任何短信
- 选择退出违规： 继续向已选择退出的收件人发送消息
- 伪造发件人ID： 使用虚假或未经授权的发件人ID
- 欺骗性内容： 包含虚假或欺诈信息的消息
- 收集的号码： 使用通过未经授权方式获得的电话号码
2. 客户责任与义务
🔴 重要：唯一责任条款
使用Selfhost SMS Gateway服务即表示客户承认：
- 客户对通过其账户发送的所有短信承担唯一和全部责任
- 客户对所有内容、收件人和后果承担全部责任
- Selfhost SMS Gateway仅作为技术传输平台，对消息内容不承担任何责任
- 任何法律索赔、损害、罚款或处罚均由客户全部承担
3. 选择加入要求
✓ 有效同意方式：
- 网站表单： 清晰的复选框（非预选）并附有明确的同意语言
- 短信关键词： 收件人发送关键词（如"YES"）选择加入
- 双重选择加入： 初始注册后进行确认（推荐）
- 书面同意： 实体或电子签名的同意表
4. 选择退出要求
📋 选择退出是缅甸消费者保护法（2019）规定的基本消费者权利
- 所有营销短信必须包含清晰的选择退出说明
- 选择退出对收件人必须免费
- 选择退出请求必须在24小时内处理
- 维护已选择退出号码的最新抑制列表
5. SIM路由和运营商通知
📱 SIM路由技术：
- SIM卡所有权： 客户使用自己的SIM卡。SIM卡所有者与移动网络运营商之间的关系是直接的，与我们的平台无关。
- 运营商政策： 移动网络运营商（MPT、Telenor、Ooredoo、Mytel）对SIM卡使用有自己的条款、定价和公平使用政策。
- 送达报告（DLR）： 消息送达状态取决于移动运营商，我们的平台不保证。
- 吞吐量（TPS）： 实际短信发送速度因运营商网络条件而异，不在我们的控制范围内。
- 发送者ID： SIM路由使用SIM卡的电话号码作为发送者。SIM路由不支持自定义发送者ID。
- 运营商封锁： 如果运营商检测到垃圾邮件模式，可能会封锁或限制短信。这是运营商政策，不是平台限制。

客户同意对因其消息活动产生的任何索赔、损害、罚款或处罚赔偿、辩护并使Selfhost SMS Gateway免受损害。此义务金额无限制且在终止后继续有效。
