Important: By using Selfhost SMS Gateway services, you agree to be bound by these Terms of Service. Please read them carefully before registering or using our platform.
🔴 CRITICAL: CLIENT SOLE RESPONSIBILITY
By using Selfhost SMS Gateway services, the Client acknowledges and expressly agrees that the Client bears SOLE AND EXCLUSIVE RESPONSIBILITY for all messages sent through their account, including but not limited to message content, recipient selection, consent verification, and compliance with all applicable laws.
1. Definitions
- "Service" refers to the Selfhost SMS Gateway platform, including REST API, SMPP interface, web portals, and related services.
- "User" or "Client" refers to any individual or entity that registers for and uses our Service.
- "SMS" refers to Short Message Service text messages sent through our platform.
- "API Key" refers to the unique authentication credential provided to access our API.
- "SMPP Credentials" refers to System ID and Password for SMPP protocol access.
2. Eligibility & Registration
2.1 Eligibility Requirements
To use our Service, you must:
- Be at least 18 years of age
- Be a legally registered business entity or authorized representative
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Service under applicable laws
2.2 KYC (Know Your Customer) Verification
All users must complete identity verification (KYC) before accessing the Service. This includes:
- Valid government-issued identification document
- Selfie/liveness verification
- Business registration documents (for business accounts)
3. Services Description
📱 SIM Route Technology: Our platform uses Android devices with physical SIM cards as SMS gateways. This is a self-hosted solution where clients manage their own gateway devices.
We provide:
- REST API for programmatic SMS sending
- SMPP v3.4 protocol interface for high-volume messaging
- Web-based client portal for account management
- Android Gateway App for SIM-based SMS routing
- Multi-operator support within Myanmar (MPT, Telenor, Ooredoo, Mytel)
4. SIM Card & Operator Disclaimer
⚠️ Important Disclaimer:
- SIM Card Ownership: Clients use their own SIM cards. The relationship between SIM card owner and mobile network operator is direct and independent of our platform.
- Operator Policies & Pricing: Mobile network operators have their own terms, pricing, and fair usage policies. These are NOT controlled by or related to our platform.
- Delivery Reports (DLR): Message delivery status depends entirely on mobile operators and is NOT guaranteed by our platform.
- Throughput (TPS): Actual SMS sending speed varies by operator network conditions and is outside our control.
- Sender ID: SIM route uses the SIM card's phone number as sender. Custom Sender IDs are NOT available with SIM routing.
- Operator Rules: Each operator (MPT, Telenor, Ooredoo, Mytel) has different rules for SMS volume, content filtering, and blocking policies. Clients must comply with their respective operator's terms.

6. User Obligations
You agree to comply with all applicable laws and regulations, including:
- Myanmar Electronic Transactions Law (2004)
- Myanmar Telecommunications Law (2013)
- Myanmar Consumer Protection Law (2019)
- PTD Consumer Protection Code
- All applicable data protection and privacy regulations
7. Prohibited Activities
⚠️ Zero Tolerance Policy: The following activities are strictly prohibited and will result in immediate account termination without refund.
- Spam: Unsolicited bulk messages without recipient consent
- Fraud/Scam: Deceptive messages intended to defraud recipients
- Phishing: Attempts to obtain sensitive information through deception
- Malware: Messages containing links to malicious software
- Adult Content: Sexually explicit or pornographic material
- Gambling: Promotion of illegal gambling activities
- Hate Speech: Content promoting discrimination or violence
- Illegal Activities: Any content promoting illegal activities
8. Payment & Billing
- Payment is required in advance (prepaid model)
- Accepted payment methods: Bank Transfer, Mobile Payment
- Credits do not expire unless the account is terminated
- No refunds for accounts terminated due to policy violations
9. Termination
We may suspend or terminate your account immediately if:
- You violate these Terms of Service
- You violate our Acceptable Use Policy or Anti-Spam Policy
- We receive complaints about your messaging activities
- We suspect fraudulent or illegal activity
- Required by law or regulatory authority
10. Limitation of Liability
Selfhost SMS Gateway operates solely as a technical transmission platform. We:
- Do NOT create, approve, review, or endorse any message content sent by Clients
- Do NOT verify the consent status of message recipients
- Do NOT guarantee message delivery or recipient response
- Do NOT accept any liability for damages arising from Client's messaging activities
10.1 Indemnification
The Client agrees to indemnify, defend, and hold harmless Selfhost SMS Gateway from any claims, damages, fines, or penalties arising from the Client's use of the Service.
11. Governing Law
🇲🇲 Myanmar Law Compliance: This agreement is governed by the laws of the Republic of the Union of Myanmar.
Including compliance with:
- Telecommunications Law (2013)
- Consumer Protection Law (2019)
- PTD Consumer Protection Code
- Electronic Transactions Law (2004)

Selfhost SMS Gateway ဝန်ဆောင်မှုများကို အသုံးပြုခြင်းဖြင့် ဖောက်သည်သည် ၎င်းတို့၏ အကောင့်မှတစ်ဆင့် ပေးပို့သော မက်ဆေ့ချ်အားလုံးအတွက် တစ်ဦးတည်းသော နှင့် သီးသန့်တာဝန် ရှိကြောင်း အသိအမှတ်ပြုပြီး သဘောတူပါသည်။ မက်ဆေ့ချ်အကြောင်းအရာ၊ လက်ခံသူရွေးချယ်မှု၊ သဘောတူညီချက်အတည်ပြုခြင်း နှင့် သက်ဆိုင်ရာဥပဒေများအားလုံးကို လိုက်နာခြင်းတို့ပါဝင်သည်။
၁။ အဓိပ္ပာယ်ဖွင့်ဆိုချက်များ
- "ဝန်ဆောင်မှု" ဆိုသည်မှာ Selfhost SMS Gateway platform ကိုဆိုလိုပြီး REST API၊ SMPP interface၊ web portals နှင့် ဆက်စပ်ဝန်ဆောင်မှုများပါဝင်သည်။
- "အသုံးပြုသူ" သို့မဟုတ် "ဖောက်သည်" ဆိုသည်မှာ ကျွန်ုပ်တို့၏ ဝန်ဆောင်မှုအတွက် မှတ်ပုံတင်ပြီး အသုံးပြုသော မည်သည့်ပုဂ္ဂိုလ် သို့မဟုတ် အဖွဲ့အစည်းကိုမဆို ဆိုလိုသည်။
- "SMS" ဆိုသည်မှာ ကျွန်ုပ်တို့၏ platform မှတစ်ဆင့် ပေးပို့သော Short Message Service စာသားမက်ဆေ့ချ်များကို ဆိုလိုသည်။
- "API Key" ဆိုသည်မှာ ကျွန်ုပ်တို့၏ API ကိုဝင်ရောက်ရန် ပေးအပ်ထားသော ထူးခြားသော အထောက်အထားကို ဆိုလိုသည်။
၂။ အရည်အချင်းသတ်မှတ်ချက် နှင့် မှတ်ပုံတင်ခြင်း
၂.၁ အရည်အချင်းလိုအပ်ချက်များ
ကျွန်ုပ်တို့၏ ဝန်ဆောင်မှုကို အသုံးပြုရန်:
- အသက် ၁၈ နှစ်အနည်းဆုံး ပြည့်ရမည်
- တရားဝင်မှတ်ပုံတင်ထားသော စီးပွားရေးလုပ်ငန်း သို့မဟုတ် ခွင့်ပြုချက်ရကိုယ်စားလှယ် ဖြစ်ရမည်
- ချုပ်ဆိုနိုင်သော သဘောတူညီချက်များ ချုပ်ဆိုရန် ဥပဒေအရ စွမ်းရည်ရှိရမည်
- သက်ဆိုင်ရာဥပဒေများအရ ဝန်ဆောင်မှုအသုံးပြုခြင်းမှ တားမြစ်ခံထားရသူ မဖြစ်ရ
၂.၂ KYC (ဖောက်သည်ကိုသိရှိခြင်း) အတည်ပြုခြင်း
အသုံးပြုသူအားလုံးသည် ဝန်ဆောင်မှုကို ဝင်ရောက်မသုံးမီ အထောက်အထားအတည်ပြုခြင်း (KYC) ပြီးမြောက်ရမည်:
- တရားဝင် အစိုးရထုတ်ပေးသော မှတ်ပုံတင်စာရွက်စာတမ်း
- Selfie/liveness အတည်ပြုခြင်း
- စီးပွားရေးမှတ်ပုံတင်စာရွက်စာတမ်းများ (စီးပွားရေးအကောင့်များအတွက်)
၃။ ဝန်ဆောင်မှုဖော်ပြချက်
📱 SIM Route နည်းပညာ: ကျွန်ုပ်တို့၏ platform သည် Android ဖုန်းများနှင့် SIM ကတ်များကို SMS gateway အဖြစ် အသုံးပြုသည်။ ဤသည်မှာ ဖောက်သည်များက မိမိတို့၏ gateway devices များကို စီမံခန့်ခွဲသော self-hosted solution ဖြစ်သည်။
ကျွန်ုပ်တို့ ပေးဆောင်သည်:
- SMS ပေးပို့ခြင်းအတွက် REST API
- အများအပြား မက်ဆေ့ချ်ပေးပို့ခြင်းအတွက် SMPP v3.4 protocol interface
- အကောင့်စီမံခန့်ခွဲမှုအတွက် Web-based client portal
- SIM-based SMS routing အတွက် Android Gateway App
- မြန်မာနိုင်ငံအတွင်း Multi-operator support (MPT, Telenor, Ooredoo, Mytel)
၄။ SIM ကတ်နှင့် အော်ပရေတာဆိုင်ရာ ရှင်းလင်းချက်
⚠️ အရေးကြီးသော ရှင်းလင်းချက်:
- SIM ကတ်ပိုင်ဆိုင်မှု: ဖောက်သည်များသည် မိမိတို့၏ SIM ကတ်များကို အသုံးပြုသည်။ SIM ကတ်ပိုင်ရှင်နှင့် မိုဘိုင်းကွန်ရက်အော်ပရေတာကြား ဆက်ဆံရေးသည် တိုက်ရိုက်ဖြစ်ပြီး ကျွန်ုပ်တို့ platform နှင့် သီးခြားဖြစ်သည်။
- အော်ပရေတာမူဝါဒများနှင့် စျေးနှုန်းများ: မိုဘိုင်းကွန်ရက်အော်ပရေတာများတွင် မိမိတို့၏ စည်းမျဉ်းများ၊ စျေးနှုန်းများနှင့် fair usage policies များရှိသည်။ ဤတို့သည် ကျွန်ုပ်တို့ platform နှင့် မသက်ဆိုင်ပါ။
- Delivery Reports (DLR): မက်ဆေ့ချ်ပို့ဆောင်မှုအခြေအနေသည် မိုဘိုင်းအော်ပရေတာများပေါ် လုံးဝမူတည်ပြီး ကျွန်ုပ်တို့ platform က အာမမခံပါ။
- Throughput (TPS): အမှန်တကယ် SMS ပို့နှုန်းသည် အော်ပရေတာကွန်ရက်အခြေအနေများအလိုက် ကွဲပြားပြီး ကျွန်ုပ်တို့ထိန်းချုပ်မှုပြင်ပတွင် ရှိသည်။
- Sender ID: SIM route သည် SIM ကတ်၏ ဖုန်းနံပါတ်ကို sender အဖြစ် အသုံးပြုသည်။ Custom Sender IDs များကို SIM routing ဖြင့် မရနိုင်ပါ။
- အော်ပရေတာစည်းမျဉ်းများ: အော်ပရေတာတစ်ခုချင်းစီ (MPT, Telenor, Ooredoo, Mytel) တွင် SMS ပမာဏ၊ content filtering နှင့် blocking policies များအတွက် မတူညီသော စည်းမျဉ်းများရှိသည်။ ဖောက်သည်များသည် မိမိတို့၏ သက်ဆိုင်ရာအော်ပရေတာ၏ စည်းမျဉ်းများကို လိုက်နာရမည်။

၇။ တားမြစ်ထားသော လုပ်ဆောင်ချက်များ
⚠️ လုံးဝခွင့်မပြုသော မူဝါဒ: အောက်ပါလုပ်ဆောင်ချက်များကို တင်းကျပ်စွာ တားမြစ်ထားပြီး ငွေပြန်အမ်းခြင်းမရှိဘဲ အကောင့်ချက်ချင်းပိတ်သိမ်းခြင်း ခံရမည်။
- Spam: လက်ခံသူသဘောတူညီချက်မရှိဘဲ အများအပြားမက်ဆေ့ချ်များ
- လိမ်လည်မှု/Scam: လက်ခံသူများကို လိမ်လည်ရန် ရည်ရွယ်သော လှည့်ဖြားမက်ဆေ့ချ်များ

- အကောင့်ပိတ်သိမ်းခြင်းမရှိလျှင် credits များ သက်တမ်းမကုန်ပါ
- မူဝါဒချိုးဖောက်မှုကြောင့် ပိတ်သိမ်းခံရသော အကောင့်များအတွက် ငွေပြန်အမ်းခြင်းမရှိပါ
၉။ ရပ်ဆိုင်းခြင်း
အောက်ပါအခြေအနေများတွင် သင့်အကောင့်ကို ချက်ချင်းဆိုင်းငံ့ သို့မဟုတ် ပိတ်သိမ်းနိုင်သည်:
- ဤဝန်ဆောင်မှုစည်းမျဉ်းများကို ချိုးဖောက်ပါက
- ကျွန်ုပ်တို့၏ လက်ခံနိုင်သောအသုံးပြုမှုမူဝါဒ သို့မဟုတ် Spam ဆန့်ကျင်ရေးမူဝါဒကို ချိုးဖောက်ပါက
- သင့်မက်ဆေ့ချ်လုပ်ဆောင်ချက်များအကြောင်း တိုင်ကြားချက်များ ရရှိပါက
- လိမ်လည်မှု သို့မဟုတ် တရားမဝင်လုပ်ဆောင်ချက် သံသယရှိပါက
- ဥပဒေ သို့မဟုတ် စည်းမျဉ်းအာဏာပိုင်က လိုအပ်ပါက
၁၀။ တာဝန်ကန့်သတ်ချက်
Selfhost SMS Gateway သည် နည်းပညာပို့လွှတ်မှု platform အဖြစ်သာ လုပ်ဆောင်သည်။ ကျွန်ုပ်တို့:
- ဖောက်သည်များပေးပို့သော မက်ဆေ့ချ်အကြောင်းအရာကို ဖန်တီး၊ အတည်ပြု၊ ပြန်လည်သုံးသပ် သို့မဟုတ် ထောက်ခံခြင်း မပြုပါ
- မက်ဆေ့ချ်လက်ခံသူများ၏ သဘောတူညီချက်အခြေအနေကို အတည်မပြုပါ
- မက်ဆေ့ချ်ပို့ဆောင်မှု သို့မဟုတ် လက်ခံသူတုံ့ပြန်မှုကို အာမမခံပါ
- ဖောက်သည်၏ မက်ဆေ့ချ်လုပ်ဆောင်ချက်များမှ ဖြစ်ပေါ်လာသော ပျက်စီးမှုများအတွက် တာဝန်မယူပါ
၁၀.၁ လျော်ကြေးပေးရန်တာဝန်
ဖောက်သည်သည် ဝန်ဆောင်မှုအသုံးပြုမှုမှ ဖြစ်ပေါ်လာသော မည်သည့်တောင်းဆိုမှု၊ ပျက်စီးမှု၊ ဒဏ်ငွေ သို့မဟုတ် ပြစ်ဒဏ်များအတွက် Selfhost SMS Gateway ကို လျော်ကြေးပေး၊ ကာကွယ်၊ နှင့် ထိခိုက်မှုကင်းစေရန် သဘောတူသည်။
၁၁။ အုပ်ချုပ်သောဥပဒေ
🇲🇲 မြန်မာဥပဒေလိုက်နာမှု: ဤသဘောတူညီချက်သည် ပြည်ထောင်စုသမ္မတမြန်မာနိုင်ငံတော်၏ ဥပဒေများဖြင့် အုပ်ချုပ်သည်။

使用Selfhost SMS Gateway服务即表示客户承认并明确同意，客户对通过其账户发送的所有消息承担唯一和全部责任，包括但不限于消息内容、收件人选择、同意验证以及遵守所有适用法律。
1. 定义
- "服务"是指Selfhost SMS Gateway平台，包括REST API、SMPP接口、网络门户和相关服务。
- "用户"或"客户"是指注册并使用我们服务的任何个人或实体。
- "SMS"是指通过我们平台发送的短消息服务文本消息。
- "API密钥"是指用于访问我们API的唯一身份验证凭据。
2. 资格与注册
2.1 资格要求
要使用我们的服务，您必须：
- 年满18岁
- 是合法注册的商业实体或授权代表
- 具有签订具有约束力协议的法律能力
- 未被适用法律禁止使用该服务
2.2 KYC（了解您的客户）验证
所有用户必须在访问服务之前完成身份验证（KYC）：
- 有效的政府签发的身份证明文件
- 自拍/活体验证
- 商业注册文件（用于商业账户）
3. 服务描述
📱 SIM路由技术： 我们的平台使用带有物理SIM卡的Android设备作为短信网关。这是一个自托管解决方案，客户管理自己的网关设备。
我们提供：
- 用于程序化SMS发送的REST API
- 用于大量消息传递的SMPP v3.4协议接口
- 用于账户管理的基于Web的客户门户
- 用于基于SIM的短信路由的Android网关应用
- 缅甸境内多运营商支持（MPT、Telenor、Ooredoo、Mytel）
4. SIM卡和运营商免责声明
⚠️ 重要声明：
- SIM卡所有权： 客户使用自己的SIM卡。SIM卡所有者与移动网络运营商之间的关系是直接的，与我们的平台无关。
- 运营商政策和定价： 移动网络运营商有自己的条款、定价和公平使用政策。这些不受我们平台控制或与之相关。
- 送达报告（DLR）： 消息送达状态完全取决于移动运营商，我们的平台不保证。
- 吞吐量（TPS）： 实际短信发送速度因运营商网络条件而异，不在我们的控制范围内。
- 发送者ID： SIM路由使用SIM卡的电话号码作为发送者。SIM路由不支持自定义发送者ID。
- 运营商规则： 每个运营商（MPT、Telenor、Ooredoo、Mytel）对短信量、内容过滤和封锁政策有不同的规则。客户必须遵守各自运营商的条款。

6. 用户义务
您同意遵守所有适用的法律法规，包括：
- 缅甸电子交易法（2004）
- 缅甸电信法（2013）
- 缅甸消费者保护法（2019）
- PTD消费者保护准则
- 所有适用的数据保护和隐私法规
7. 禁止活动
⚠️ 零容忍政策：以下活动被严格禁止，将导致立即终止账户且不退款。
- 垃圾邮件：未经收件人同意的批量消息
- 欺诈/诈骗：旨在欺骗收件人的欺骗性消息

8. 付款与计费
- 需要预付款（预付模式）
- 接受的付款方式：银行转账、移动支付
- 除非账户被终止，否则积分不会过期
- 因违反政策而被终止的账户不予退款
9. 终止
在以下情况下，我们可能会立即暂停或终止您的账户：
- 您违反本服务条款
- 您违反我们的可接受使用政策或反垃圾邮件政策
- 我们收到有关您消息活动的投诉
- 我们怀疑存在欺诈或非法活动
- 法律或监管机构要求
10. 责任限制
Selfhost SMS Gateway仅作为技术传输平台运营。我们：
- 不创建、批准、审查或认可客户发送的任何消息内容
- 不验证消息收件人的同意状态
- 不保证消息送达或收件人响应
- 不对客户消息活动造成的任何损害承担责任
10.1 赔偿
客户同意对因使用服务而产生的任何索赔、损害、罚款或处罚，赔偿、辩护并使Selfhost SMS Gateway免受损害。
